Notice of Procedural Change – Deadline to Submit Dispositive Orders

Be advised that the deadline to submit dispositive orders for cases assigned to Judge Woodard will change effective June 5, 2017.

Under the current procedure, following resolution of a matter pending before the Court, a deadline is set for submission of a proposed order.  Upon expiration of the initial deadline, if no order has been submitted, the Court will enter an order directing the responsible party to submit a proposed order within 14 days.  If the party fails to timely submit a proposed order, the Court will enter a second “order to submit,” directing the responsible party to submit a proposed order.  Following the expiration of the second 14-day period, if a proposed order has not been submitted, the Court may dismiss the matter or enter a show cause order against the responsible party.

Effective June 5, 2017, the Court will enter only one “order to submit” directing the responsible party to submit a proposed order within 14 days.  If an “order to submit” is entered in a case on, or before, June 5, 2017, no second “order to submit” will be issued.  In the event a proposed order is not timely submitted, the Court may dismiss the pending matter or enter a show cause order against the responsible party.

As a general reminder, pursuant to Miss. R. Bankr. P. 5005-1(a)(2)(D)(i), a proposed order must be submitted to the Court with every motion filed.
