New Supplemental Proof of Claim for CARES Forbearance Claim

Friday, February 26, 2021

On December 27, 2020, the Consolidated Appropriations Act created a new (temporary) Section 501(f) of the Bankruptcy Code which permits an “eligible creditor” to file a supplemental proof of claim for a CARES Act forbearance claim in a chapter 13 case.

The federal judiciary created a new form to file a supplemental proof of claim.  The form (which is available for download at www.uscourts.gov) will sunset with the temporary Code provision on December 27, 2021.

ECF filers should use the following event to file the new supplemental claim form: Bankruptcy > Claim Actions > Supplemental Proof of Claim for CARES Forbearance Claim.
